Hemp Law Changes Effective July 1, 2023
What you need to know about the new hemp regulations, including Delta 8, Delta 10, HHC, THCo, THCp, THCv, and THCa. that go into effect July 1, 2023.
TGC is the only organization who represents the entire supply chain in the Tennessee hemp industry.
Definitions: Hemp derived cannabinoid (Delta 8, Delta 10, HHC, THCo, THCp, THCv, and THCa), manufacture, retailer, serving and supplier are all defined starting July 1, 2023.
Age restrictions: All products containing any hemp derived cannabinoids can only be sold to those who are 21+ years old.
Hemp Derived Cannabinoid products must be behind the counter if not in a 21+ only retail establishment
Ad added 6% tax must be added to sales of hemp derived cannabinoid products.
Samples containing a hemp derived cannabinoid cannot be handed out in or on a public street, sidewalk, or park.
Violations of these laws will now result in a class A misdemeanor.
Hemp Law Changes Effective July 1, 2024
The rules on the specifics are still being drafted by the Department of Agriculture and the Department of Revenue. TGC is engaged in the process with the Departments to ensure common sense regulations, that promote consumer safety and are not harmful to the industry, are implemented.
Annual licenses for all segments of the industry: retailers, manufactures, suppliers, etc.
Lab testing requirements:
Full-panel testing on all active cannabinoid molecules must be conducted prior to final production of products containing a hemp-derived cannabinoid; and
A potency test must be conducted on finished goods to confirm potency is consistent with stated potency on the packaging.
Retail locations must be 1,000 ft away from K-12 schools.
