SAVE THCA LAWSUIT

December 18, 2024

Court Update:

On Monday December 16, 2024 the Court heard both of our hemp lawsuits - Total THC and Hemp Flowers. Alex Little from the Hemp Law Group represented us extremely well! We could not be any happier about his work. We have been working up to this moment for over a year now!

No decision was made by the judge, but we will have a conclusion by Friday, December 20, 2024! We are confident in our arguments and team! We will update everyone as soon as we hear from the judge!

WE HAD A HEMP WIN DECEMBER 18, 2024!

In May of 2024 Spring Hill Police Department seized 231 pounds of legal hemp from Old School Vapor and SAK Wholesale in Columbia, Tennessee—based partly on District Attorney Brent Cooper’s inflammatory claim that hemp and marijuana are “the same damn thing.” That statement has proven to be both legally and financially costly.

In a landmark settlement that underscores the critical legal differences between hemp and marijuana, two Tennessee businesses will recover $735,000 after law enforcement illegally seized their legal hemp inventory, exposing significant gaps in local law enforcement’s understanding of cannabis regulations.

The TGC is suing the Tennessee Department of Agriculture (TDA) over their restrictive rule that bans the sale of any products containing over 0.3% TOTAL THC (THCa + THC). The industry has been self regulated since 2018 without any major issues. Since July of 2023 over 15 million dollars in tax revenue has been reported from HDC alone. The TDA’s decision to ignore the majority of the 19,000 comments made in opposition of the rules is just one of the many reasons why we are suing them.

Current Initiatives

  • SAVE THCa Lawsuit: In December of 2024, the TGC and our attorneys, The Hemp Law Group, will file the lawsuit against the TDA’s final rules.

  • Grassroots Advocacy: In preparation for the 2025 legislative session and to continue the fight to save thca, we have launched a call to action campaign to bring awareness of the industry’s voice to our leaders.

  • Education Outreach: The TDA’s rules and the TBI’s bill to ban thca even further has brought a lot of confusion and doubt in the industry. Neither issue has been finalized and the TGC is not baking down!
